Tributaci\u00f3"},"content":{"rendered":"<p style=\"text-align: justify;\">L&#8217;Ag\u00e8ncia tributaria sabr\u00e0 a partir del 2018 si hem obtingut ingressos procedents del lloguer d&#8217;apartaments tur\u00edstics a trav\u00e9s de plataformes digitals. Fins ara, a l&#8217;Administraci\u00f3 nom\u00e9s podia saber-ho si es dedicava a fer requeriments individuals als contribuents perqu\u00e8 havia vist que havien anunciat el pis, la casa, en alguna de les webs\/Apps que es dediquen a fer d&#8217;intermediaris. No obstant a partir del 2018, aquests intermediaris hauran de comunicar a Hisenda els allotjaments que s&#8217;han contractat a trav\u00e9s seu indicant els import que s&#8217;ha pagat (i que per tant es susceptible de tributar a la renda), els dies que ha estat llogat i si qui ho lloga \u00e9s el propietari o un tercer.<\/p>\n<p style=\"text-align: justify;\">\u00c9s en aquest punt que ens podem plantejar quina \u00e9s la tributaci\u00f3 d&#8217;aquest ingresos i dos s\u00f3n els elements a anlitzar: renda i IVA. Des del punt de vista de la renda els ingressos procedents del lloguer d&#8217;un apartament, pis o casa durant uns dies tributaran com un rendiment del capital immobiliari, i per tant, com qualsevol altre lloguer que es tingues durant tot l&#8217;any. No obstant, cal tenir molt en compte els dies que durant l&#8217;any est\u00e0 llogat, ja que per quan no ho estigui caldr\u00e0 fer una imputaci\u00f3 de renda immobili\u00e0ria. En el cas que el que es faci sigui nom\u00e9s el lloguer d&#8217;una habitaci\u00f3 o d&#8217;una part de l&#8217;immoble, s&#8217;hauran de prorratejar els imports en funci\u00f3 del metres quadrats.<\/p>\n<p style=\"text-align: justify;\">El fet que aquests ingressos es classifiquin com a rendiments del capital immobiliari fa que ens puguem deduir una s\u00e8rie de despeses com s\u00f3n el IBI, taxes, comunitat de ve\u00efns, assegurances, interessos hipoteca. No obstant, aquests imports s&#8217;hauran d&#8217;imputar en funci\u00f3 del n\u00famero de dies a l&#8217;any en que es tingui llogat l&#8217;immoble.<\/p>\n<p style=\"text-align: justify;\">A m\u00e9s, la normativa del IRPF preveu una reducci\u00f3 del 60% en el rendiment net (ingressos menys despeses) procedent de l&#8217;arrendament d&#8217;immobles destinats a habitatge.<\/p>\n<p style=\"text-align: justify;\">En quan a considerar si aquests ingressos han d&#8217;anar subjectes a IVA, segons la llei estan subjectes a aquest impost les entregues de b\u00e9ns i\/o prestacions de serveis realitzades per empresaris o professionals\u00a0 a t\u00edtol oner\u00f3s (retribu\u00eft) amb car\u00e0cter habitual o ocasional, en l&#8217;exercici de la seva activitat empresarial. En concret a l&#8217;article 5 de la Llei de l&#8217;IVA s&#8217;atorga la condici\u00f3 d&#8217;empresari o professional a qui realitzi una o varies entregues de b\u00e9ns o prestacions de serveis que suposin l&#8217;explotaci\u00f3 d&#8217;un b\u00e9 corporal o incorporal amb la finalitat d&#8217;obtenir ingressos continuats en el temps. En resum, el que ve a dir, es que encara que es llogui el pis un sol dia a l&#8217;any, a efectes del IVA s&#8217;\u00e9s empresari i que per tant el lloguer\u00a0 es troba subjecte a aquest impost ja sigui com a habitatge habitual o com habitatge de temporada.<\/p>\n<p style=\"text-align: justify;\">Un cop sabem que s&#8217;\u00e9s empresari a efectes de l&#8217;IVA hem de veure si aquesta operaci\u00f3 esta exempta o no d&#8217;aquest impost. L&#8217;article 20 de la llei de l&#8217;IVA recull les exempcions, i en concret en el punt 23 parla que els arrendaments destinats a habitatge es troben exemptes. No obstant, en els casos que els arrendaments d&#8217;apartaments o habitatges moblats, quan el llogater s&#8217;obligui a prestar algun dels servies complementaris propis de la industria hotelera, aleshores si que es tributa per IVA, al tipus redu\u00eft del 10%. La normativa estableix com a serveis propis de la industria hotelera entre d&#8217;altres, els d&#8217;atenci\u00f3 i recepci\u00f3 permanent, neteja peri\u00f2dica de l&#8217;immoble, canvi peri\u00f2dic de la roba de llit i bany, serveis als clients com restauraci\u00f3, tintoreriaa, custodia maletes, etc. Per al contrari no es consideren serveis complementaris propis de la industria hotelera els seg\u00fcents:<\/p>\n<ul>\n<li>Serveis de neteja i serveis de canvi de roba de l&#8217;apartament prestats a l&#8217;entrada i a la sortida del per\u00edode contractat.<\/li>\n<li>Serveis de neteja de les zones comuns de l&#8217;edifici (portal, escales i ascensors)<\/li>\n<li>Serveis d&#8217;assist\u00e8ncia t\u00e8cnica i manteniment per a eventuals reparacions<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">Per tant, el fet de prestar nom\u00e9s els serveis anteriors, fa que l&#8217;arrendament de l&#8217;habitatge estigui subjecte pero exempt de IVA.
